For customers in Switzerland, we are entitled to register the corresponding entry in the retention of title register.
For businesses: We retain ownership of the product until all claims arising from an ongoing business relationship are fully settled. You may resell the goods in the ordinary course of business; any claims arising from such resale, regardless of whether the goods are connected or mixed with a new item, are assigned to us in advance in the amount of the invoice amount, and we accept this assignment. You remain authorized to collect the claims, but we may also collect them ourselves if you fail to meet your payment obligations. 10. Transport Damage
For consumers: If goods are delivered with obvious transport damage, please immediately report such defects to the carrier and contact us as soon as possible. Failure to make a complaint or contact us will not affect your statutory rights, particularly your warranty rights. However, it will help us assert our own claims against the carrier or transport insurance.
For businesses: The risk of accidental loss or damage passes to you as soon as we deliver the item to the carrier or any other person or institution designated for the execution of the shipment.
11. Warranty and Guarantees
11.1 Warranty Rights
For consumers within the EU:
The statutory warranty rights apply.
Please return the defective product with a description of the defect to us. You will bear the transport costs. We provide a warranty by remedying the defects, either by repairing the defect (rectification) or by providing a defect-free item (replacement delivery). If the rectification fails, you are entitled to withdraw from the contract. This does not apply in the case of insignificant defects. A right to a reduction in price is excluded.
For businesses:
Unless otherwise explicitly agreed below, the statutory warranty rights apply. The following limitations and shortened time periods do not apply to claims arising from damages caused by us, our legal representatives, or vicarious agents:
- In case of injury to life, body, or health
- In case of intentional or grossly negligent breach of duty, as well as fraud
- In case of breach of essential contract obligations, the fulfillment of which enables the proper execution of the contract and on the adherence to which the contracting party can regularly rely (cardinal obligations)
- Within the scope of a warranty promise, if agreed, or
- If the scope of the Product Liability Act is opened.
Limitation for Businesses
For businesses, only our own specifications and the manufacturer's product descriptions included in the contract are considered agreements on the quality of the goods; we do not assume any liability for public statements of the manufacturer or other advertising statements. For businesses, the limitation period for warranty claims regarding newly manufactured goods is one year from the transfer of risk. The previous sentence does not apply if the item has been used for the construction of a building and caused a defect.
Note for Merchants
For merchants, the inspection and notification obligations regulated in § 377 HGB apply. If you fail to report as required, the goods are deemed accepted unless the defect was not detectable during the inspection. This does not apply if we have fraudulently concealed a defect.
11.2 Guarantees and Customer Service
Information on any additional guarantees and their exact terms can be found with each product and on specific information pages in the online store.
Customer Service: Our customer service is available for queries, complaints, and claims on working days from [hours] via phone at [phone number] as well as via email at [email address].
12. Liability
We are liable for claims due to damages caused by us, our legal representatives, or agents without limitation:
- In case of injury to life, body, or health
- In case of intentional or grossly negligent breach of duty
- In case of warranty promises, if agreed, or
- If the scope of the Product Liability Act is applied.
For violation of essential contract obligations, the fulfillment of which is necessary for the proper execution of the contract and on which the contracting party may regularly rely (cardinal obligations), liability is limited to the foreseeable damage typical for the contract. In all other cases, claims for damages are excluded.
13. Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR), which you can find here. We are willing to participate in an out-of-court dispute resolution procedure before a consumer arbitration board.
14. Final Provisions
If you are a business, Hungarian law applies excluding the UN Sales Convention.
If you are a merchant under the Commercial Code, a legal entity under public law, or a public-law special asset, the exclusive jurisdiction for all disputes arising from contractual relationships between us and you is our place of business.
If any individual clauses of these terms and conditions are wholly or partially invalid, the contract remains valid in all other respects. If individual clauses are invalid, the content of the contract is governed by the statutory provisions.
